In a recent case victory, Columbus OVI Attorney Jon Saia helped a man facing four criminal charges--two for OVI and two for a weapons offense--get completely cleared of the allegations filed against him. Through the lawyer's skillful legal representation of his client, he was able to get two of the charges dismissed prior to trial before obtaining a Not Guilty verdict for the other two charges. Here's a breakdown of the case:
The Alleged Offenses: The criminal matter stems from an incident in which Mr. Saia's client was sleeping in his vehicle. A law enforcement officer saw him asleep at the wheel and woke him up. As the man was looking for his driver's license, the officer spotted the handgun in the vehicle's console. This is what led to the weapons charges. The officer also suspected Attorney Saia's client of OVI (or operating a vehicle under the influence of alcohol or drugs) and asked the man to take standardized field sobriety tests. The man refused to take these tests and was later administered a blood test, considering that the officer had obtained a warrant for such testing. The man's blood alcohol concentration (BAC) registered at 0.134. Under the law, individuals who operate vehicles are legally prohibited from having BAC levels of 0.08% or higher.
The Charges: Attorney Saia's client ended up being charged with two OVI charges and two charges for improper handling of a firearm.
The Results: Mr. Saia went straight to work for his client's defense. He made strong arguments on the defendant's behalf in pre-trial motion hearings, which led to one OVI count and one firearms count being dismissed. The lawyer's strong defense continued as the case went to jury trial. Thanks to Mr. Saia's skillful representation of the defendant during this critical stage of the case, the man was acquitted of the last two charges. The jury only deliberated for about an hour before submitting the verdict of Not Guilty.
This is just one of the many cases in which Attorney Saia has provided his clients with unwavering legal advocacy that allowed them to completely avoid conviction.
