Attorney Jon Saia Interviewed About Repeat Drunk Driver Case

Attorney Jon Saia has years of experience handling OVI cases in Ohio, and his insight was recently sought out by ABC 6 for a story about a repeat drunk driver. A Columbus woman was arrested for her fifth OVI offense and was also charged with aggravated vehicular assault for hitting a teen girl last month. Additionally, authorities reported that the woman was driving with a suspended license at the time that she struck and critically injured the 14-year-old girl in East Columbus on September 25th. The victim remains in the hospital, recovering from a number of serious injuries.

Under Ohio law, OVI convictions only remain on a person’s record for six years, and each subsequent offense during that time period will result in increased penalties. Once six years have passed, any new OVI conviction will be considered a first offense and prosecuted as such.

Attorney Saia noted that the woman “…picked up her third offense in 2006; that would have been treated as a first offense OVI again.” The woman was also charged with OVI in 2012 and had her license suspended for three years and spent time in jail. However, the 2012 case is still considered to be active.

“She did receive some harsher penalties from the judge on that case,” Attorney Saia commented. The judge also ordered the woman to have an ignition interlock device installed in her car. Officials are unsure of whether it was installed in the vehicle she was driving at the time of the most recent offense.

The woman’s bond was set at more than $100,000 and she is expected to be back in court later this month for violating probation.
