As the man was looking for his driver’s license, the officer spotted the handgun in the vehicle’s console. This is what led to the weapons charges. The officer also suspected Attorney Saia’s client of OVI (or operating a vehicle under the influence of alcohol or drugs) and asked the man to take standardized field sobriety tests. The man refused to take these tests and was later administered a blood test, considering that the officer had obtained a warrant for such testing. The man’s blood alcohol concentration (BAC) registered at 0.134. Under the law, individuals who operate vehicles are legally prohibited from having BAC levels of 0.08% or higher.
The Charges: Attorney Saia’s client ended up being charged with two OVI charges and two charges for improper handling of a firearm.
