Grounds For Divorce In Ohio

If you are considering filing for divorce, you must first fulfill certain requirements. First of all, you must state the grounds for divorce. In addition to irreconcilable difference, grounds to file for divorce can include:

  • Adultery
  • Desertion for up to one year
  • Drug or alcohol abuse
  • Extreme cruelty
  • Fraudulent marital contract
  • Gross neglect of marital duties
  • Imprisonment at the time of filing a divorce
  • Incompatibility, unless denied by either party
  • Living separate and apart from one another through a legal separation agreement
  • Your spouse had a living husband or wife at the time of your marriage

Ohio’s family court requires that husband and wife complete a separation agreement that settles all property disputes and issues related to child support and custody. This agreement is then submitted to the court along with a request for the termination of a marriage. If either wife or husband cannot agree on any aspect of a separation at any point during the process, one must file a complaint with the court, and the case is then converted into a divorce.
