How Collaborative Divorce Works

Unlike mediation, in which a couple works with one mediator, collaborative divorce allows both spouses and their own, separate attorneys to all work together on a divorce agreement outside the courtroom. The first step of this process is for all parties to sign a “participation agreement” to commit to the cooperation this divorce method requires.

A participation agreement can address:

  • What issues need to be agreed on/resolved
  • The constructive candor that must be used in all communications
  • The commitment of the attorneys to work together to manage conflict
  • The best interest of any children involved
  • How and if neutral experts can be obtained for assistance
  • Rules for ending or withdrawing from the process
